Welcome to Tarotdoxa. These Terms of Service (“Terms”) govern your access to and use of the Tarotdoxa mobile application and related services (the “Service”) operated by Tarotdoxa LLC (“Tarotdoxa,” “we,” “us,” or “our”).

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 17 years old to use the Service. By using the Service, you represent that you meet this age requirement.

2. What Tarotdoxa Is

Tarotdoxa is a tarot reading application that uses an AI reading engine trained on the voice and methods of co-founder Holly Cole. The Service is intended for entertainment, self-reflection, and personal exploration.

The Service does not require an account. You access readings directly through the app.

5. In-App Purchases

The Service offers optional in-app purchases (such as subscriptions or additional reading tiers) processed through Apple’s App Store. Pricing, billing, and refunds for these purchases are subject to Apple’s terms and policies. If you have a billing dispute, please contact Apple Support directly.

Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. You can manage and cancel subscriptions through your Apple ID account settings.

6. Intellectual Property

The Service, including its design, code, content, card interpretation method, voice patterns, and reading outputs, is owned by Tarotdoxa LLC and protected by copyright, trademark, and other intellectual property laws.

You receive a limited, personal, non-transferable, non-exclusive license to use the Service for your own personal, non-commercial purposes.

The Rider-Waite-Smith tarot deck imagery used in the Service is in the public domain in the United States and the United Kingdom.

7. User Content

If you submit feedback, suggestions, or other content to us (for example, by emailing us), you grant Tarotdoxa LLC a perpetual, royalty-free, worldwide license to use that content to improve the Service. We will not publish your identifying information without your separate consent.

8. Reading Content and Training Data

Each reading is generated for your personal use. We do not retain your reading after it is delivered.

We will never use your readings as training data without your explicit, separate, written consent. If we ever wish to use specific reading interactions for product improvement, we will request consent through a clear, opt-in mechanism.

9. Service Availability

We make reasonable efforts to keep the Service available but do not guarantee uninterrupted access. The Service may be unavailable from time to time due to maintenance, infrastructure issues, or factors outside our control. We are not liable for downtime.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT ANY READING WILL BE ACCURATE, COMPLETE, OR PROVE PROPHETIC. TAROT IS AN INTERPRETIVE PRACTICE, NOT A PREDICTIVE SCIENCE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TAROTDOXA LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, INCLUDING LOSS OF PROFITS, DATA, OR USE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (b) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Tarotdoxa LLC, its members, officers, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Service.

13. Termination

We may suspend or terminate your access to the Service at our discretion if you violate these Terms or use the Service in a manner that could harm us, other users, or third parties. You may stop using the Service at any time.

Provisions that by their nature should survive termination (including Sections 6, 8, 10, 11, 12, 14, and 15) will survive.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or the Service shall be resolved as follows:

  1. Good faith discussion first. You and we agree to attempt to resolve any dispute through direct, good-faith communication for at least 30 days before initiating any formal proceeding.
  2. Mediation. If direct discussion fails, the parties shall engage a mutually-acceptable mediator within 30 days. Mediation will be conducted in Oregon.
  3. Binding arbitration. If mediation fails to resolve the dispute within 60 days of its commencement, the matter shall be submitted to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in Oregon by a single arbitrator. The arbitrator’s decision shall be final and enforceable in any court of competent jurisdiction.

Notwithstanding the above, either party may seek injunctive relief in court for matters relating to intellectual property infringement or breach of confidentiality.

YOU AND TAROTDOXA LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in the app and via the Effective Date above. Your continued use of the Service after any change constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service.

16. Apple End User License Agreement

If you downloaded the Service from the Apple App Store, the Service is also subject to Apple’s Licensed Application End User License Agreement at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, the terms of which are incorporated by reference. To the extent these Terms conflict with Apple’s EULA, Apple’s EULA controls solely with respect to Apple’s relationship with you.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Tarotdoxa LLC regarding the Service and supersede any prior agreements.
